  • Branding & Strategy

All services are subject to a written agreement, proposal, or invoice confirmation.

2. Client Responsibilities

Clients agree to:

  • Provide accurate business information

  • Provide necessary access (ad accounts, website backend, analytics, etc.)

  • Approve content, creatives, and campaigns on time

  • Make payments as agreed

Delays in approvals or access may impact campaign performance and timelines.

3. Payments & Fees

  • All service fees will be defined in a proposal or invoice.

  • Payments must be made as per agreed schedule.

  • Late payments may result in service suspension.

  • Ad budgets (Google, Meta, etc.) are separate from agency service fees.

Unless otherwise agreed, fees paid for services are non-refundable.

4. No Guaranteed Results

BD Creation follows data-driven strategies to deliver measurable growth.

However, we do not guarantee:

  • Specific revenue amounts

  • Guaranteed ROI

  • Guaranteed search engine rankings

  • Platform approval decisions

Digital marketing performance depends on multiple external factors including market competition, platform algorithm changes, and customer behavior.

5. Intellectual Property

  • All creative assets (ads, designs, content) created after full payment remain client property unless otherwise stated.

  • BD Creation retains the right to showcase completed projects in its portfolio unless agreed otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential information private and not disclose business-sensitive information to third parties.

7. Third-Party Platforms

Our services may involve third-party platforms such as:

  • Google

  • Meta (Facebook/Instagram)

  • LinkedIn

  • Shopify

  • Hosting providers

We are not responsible for:

  • Account suspensions

  • Platform policy changes

  • Algorithm updates

  • Technical issues caused by third-party platforms

8. Termination

Either party may terminate services with written notice as per agreement terms.

In case of termination:

  • Outstanding payments must be cleared.

  • Work completed until termination date will be billable.

9. Limitation of Liability

BD Creation shall not be liable for:

  • Indirect or consequential losses

  • Business interruption

  • Loss of revenue due to market factors

  • Technical failures outside our control

Our total liability shall not exceed the service fee paid for the specific service period.

10. International Clients

As we serve clients globally, services may be delivered remotely.
All disputes shall be governed by applicable laws of India unless otherwise agreed.

11. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Updated versions will be published on this page.
